Star99 Pvt Ltd (“we”, “us”, “our”, “Company”) operates the website https://star99.pk and any associated mobile applications (collectively, the “Platform“). These Terms and Conditions (“Terms“) govern your access to and use of the Platform, placement of orders, and all related services (collectively, the “Services“).

By accessing, browsing, or using the Platform or placing any order, you agree to be bound by these Terms in their entirety. If you do not agree with any part of these Terms, you must immediately discontinue use of the Platform and refrain from placing orders.

We reserve the right to modify, update, or replace any part of these Terms at any time. The most current version will be posted on the Platform with the updated “Last updated” date. Continued use of the Platform after changes constitutes acceptance of the revised Terms.

1. Use of the Platform

You must be at least 18 years old and legally capable of entering into binding contracts to use the Platform.
You agree to provide accurate, current, and complete information during registration, ordering, or any other interaction.
We reserve the right (but have no obligation) to refuse service, terminate accounts, remove or edit content, or cancel orders at our sole discretion without notice or liability.
You may not use the Platform for any illegal, fraudulent, harmful, or unauthorized purpose, including but not limited to infringement of intellectual property, defamation, harassment, spamming, or transmission of viruses/malware.

2. Orders and Contract Formation

All orders placed are subject to availability and our acceptance.
Display of products and prices on the Platform constitutes an invitation to treat only — no contract arises until we send you an order confirmation email/SMS.
We reserve the absolute right to accept or reject any order (in whole or in part) for any reason, including suspected fraud, pricing errors, stock unavailability, or non-compliance with these Terms.
We may cancel or refuse to fulfill any order even after confirmation without liability, except for refund of any amounts already paid (where applicable).
Product descriptions, images, specifications, and prices are provided for general information only and may contain errors. We do not warrant that they are accurate, complete, or current.

3. Pricing and Payment

All prices are in Pakistani Rupees (PKR) and include applicable taxes unless stated otherwise.
We reserve the right to correct obvious pricing errors (even after order confirmation) and to cancel affected orders.
Payment is due in full at the time of order placement. We use third-party payment processors; you agree to comply with their terms.
Title and risk of loss pass to you only upon full payment and delivery (or collection) of goods.
You are solely responsible for all charges, including any customs duties, import taxes, or additional fees (if any).

4. Delivery, Shipping, and Risk

Delivery timelines are estimates only. We are not liable for any delay, non-delivery, or misdelivery caused by third-party couriers, force majeure, or events beyond our reasonable control.
Risk of loss or damage passes to you upon handover to the courier (or upon collection if self-pickup).
You must inspect goods immediately upon receipt and report any visible damage, shortage, or discrepancy within 24 hours via our support channels. Failure to do so waives any claim related to delivery condition.

5. Returns, Refunds, and Cancellations (Seller-Favorable Policy)

All sales are final unless otherwise stated for specific products.
Returns/refunds are granted solely at our sole discretion and only in cases of proven manufacturing defects or material non-conformity (not for change-of-mind, buyer’s remorse, incorrect size/color preference, or buyer’s error).
Return window (where applicable) is strictly limited to 7 calendar days from delivery for eligible items only. Items must be unused, in original packaging with all tags/labels intact, and accompanied by proof of purchase.
We do not accept returns for perishable goods, intimate items, customized/made-to-order products, digital downloads, or items marked “final sale/non-returnable”.
Refunds (if approved) exclude original shipping fees, return shipping costs, restocking fees (up to 20–30%), and any discounts/promotions applied to the original order.
Refunds are processed to the original payment method within 14–30 business days (subject to third-party processor timelines). No cash-on-delivery refunds in cash.
We reserve the right to reject any return/refund request without explanation.

6. Intellectual Property

All content on the Platform (text, graphics, logos, images, software, designs, product photos) is owned by us or our licensors and protected by copyright, trademark, and other intellectual property laws of Pakistan and internationally.
You are granted a limited, revocable, non-exclusive, non-transferable license to view and use the Platform for personal, non-commercial purposes only.
You may not copy, reproduce, modify, distribute, display, perform, publish, create derivative works from, or exploit any content without our prior written consent.
Any unauthorized use terminates the limited license immediately and may result in legal action.

7. Limitation of Liability (Maximum Protection)

To the maximum extent permitted by law, we provide the Platform and Services on an “as is” and “as available” basis without any warranties of any kind (express or implied), including but not limited to merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, or uninterrupted access.
We shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of the Platform, products, or Services — even if advised of the possibility of such damages.
Our total aggregate liability (if any) shall in no event exceed the amount actually paid by you for the specific product/order giving rise to the claim.
We are not liable for any loss due to: force majeure events, third-party actions (couriers, payment processors), your failure to provide accurate information, internet failures, cyber-attacks, or any act/omission beyond our reasonable control.

8. Indemnification

You agree to indemnify, defend, and hold harmless Star99 Pvt Ltd, its officers, directors, employees, agents, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Platform/Services; (b) your violation of these Terms; (c) your infringement of any third-party rights; or (d) any content or information you submit/upload.

9. Termination

We may suspend or terminate your access to the Platform or any order at any time, without notice or liability, for any reason (including suspected breach of these Terms).

10. Governing Law and Dispute Resolution

These Terms are governed exclusively by the laws of the Islamic Republic of Pakistan (excluding conflict of laws principles). Any dispute, controversy, or claim arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Lahore, Punjab, Pakistan.

11. Miscellaneous

These Terms constitute the entire agreement between you and us regarding the subject matter and supersede all prior understandings.
If any provision is held invalid or unenforceable, the remaining provisions remain in full force and effect.
Our failure to enforce any right or provision does not constitute a waiver.
You may not assign or transfer any rights/obligations under these Terms without our prior written consent. We may assign these Terms freely.
